Terms and Conditions of Use (Data User Agreement) 

Please read this document carefully. It governs your use of the data story made available on this website. The agreement states the terms and conditions under which you, the Data User, may access and use the data story and all other materials displayed or made available through the data story.

#NotInMyCity (NIMC) is the current Data Steward for the Alberta Human Trafficking Data Portal Project, delegated to PolicyWise for Children & Families (PolicyWise) to support. The Data Steward may revise the terms of use from time to time. Data Users will be notified of updates to the terms of use through posts on the data story website.

Definitions

  1. “Data Contributors” in the plural refers to the broader list of organizations that have each signed a data sharing agreement as a Data Contributor and are participating in data sharing for the AHTDP project.
  2. “Data Steward” refers to the organization or their delegate that is responsible for managing the shared data, defining the procedures and policies for data access and use, ensuring the security, confidentiality, and quality of the data, and resolving any data issues that emerge.
  3. “Data Users” refer to staff and/or volunteers at Trusted Partners who agree to the terms and conditions to access the Data Story for the purposes described in this agreement.
  4. “Trusted Partners” refers to organizations who are members of the Provincial Human Trafficking Network.
  5. “Terms and Conditions of Use” refers to the Data User agreement agreed to by Data Users to be able to access the Data Story.

Background and Purpose

In April 2021, #NotInMyCity, a facilitative organization that focuses on raising awareness and taking collective action to prevent and end human trafficking and sexual exploitation, received a Civil Society Fund grant from the Community and Social Services Ministry of Alberta for the Alberta Human Trafficking Data Portal (AHTDP) project. The AHTDP project aims to tell a more complete story of human trafficking in Alberta, including by developing this data story which brings together data on human trafficking from both law enforcement and community services. The AHTDP project is led by #NotInMyCity and supported by PolicyWise for Children & Families as a sub-contractor.

The data story, created as part of the Alberta Human Trafficking Data Portal (AHTDP) project, is being made available to:

  1. create and sustain collaborations that can strengthen the collection and reporting of aggregate human trafficking data.
  2. create awareness around human trafficking in Alberta, identify opportunities for growth and advocate for change with decision-makers.
  3. support training and education on human trafficking.

Accessing the Data Story

Data Users from Trusted Partners may access the data story in line with the terms of this agreement. Trusted Partners are organizations who are members of the Provincial Human Trafficking Network. Any new organization that wants access to the data story will need to contact the Data Steward.

Use of the Data Story

Share the data story on social media or on other forums where anyone might be able to access it on their own. The website limits access to the data story to Data Users from Trusted Partners.

Use the data story to identify gaps in data collection.

Create derivatives or adaptations of the data story that change the meaning of the data story or the representation of the data using new or different visualizations.

Use the data story to advocate for funding, resources, and support for addressing human trafficking.

Use the data story in any way that might be in violation of Canadian laws and policies.

Use the data story to understand the anti-human trafficking ecosystem in Alberta.

Use the data story in any way that might pose harm to victims/survivors of human trafficking.

Use the data story to support internal training and education among staff and volunteers.

Use the data story to misrepresent the victims/survivors of human trafficking or the scale of human trafficking.

Give proper attribution to the Alberta Human Trafficking Data Portal (AHTDP) project when citing or referring to the data story.

Use the data story in any way that might identify the victims/survivors of human trafficking.

Reach out to the Data Steward for the Alberta Human Trafficking Data Portal (AHTDP) project when in doubt about possible uses of the data story.

Use the data story to stereotype certain groups or individuals.

 

Use the data story to facilitate any kind of criminal activity.

 

Use the data story in violation of the spirit in which it was intended – i.e., to better understand human trafficking in Alberta without harming victims/survivors or creating stereotypes.

 

Permitted Uses

Any use of the data story needs to be aligned with the spirit in which it was created – i.e., to better understand human trafficking in Alberta without harming victims/survivors and without creating stereotypes about any group for the purposes described in section 1 Background and Purpose. In line with this, the following is a list of possible uses of the data story. Please note that the list below is not exhaustive and might include other possible uses of the data story which align with the spirit in which it was created.

The data story can be used to:

  • Educate others and create awareness around human trafficking in Alberta.
  • Advocate for change on anti-human trafficking policies and programs with decision-makers.
  • Advocate for funding, resources, and support for addressing human trafficking.
  • Identify opportunities for growth within anti-human trafficking organizations in terms of assisting victims/survivors of human trafficking.
  • Identify some of the key gaps in data on human trafficking.
  • Understand the nature of the anti-human trafficking ecosystem in Alberta.
  • Support training and education.

Use of the data story for these permitted uses requires proper attribution to the Alberta Human Trafficking Data Portal (AHTDP).

Any other possible uses of the data story will need to be approved by the Data Steward.

Prohibited Uses

The data story cannot be used in ways that violate the spirit in which it was created. This means that the data story cannot be used in any way to:

  • Cause physical, emotional, psychological, legal, or financial harm to the victims/survivors of human trafficking.
  • Misrepresent the victims/survivors of human trafficking or the scale of human trafficking.
  • Stereotype certain groups or individuals with regards to the prevalence of human trafficking.
  • Identify personal information about the victims/survivors of human trafficking.
  • Violate Canadian laws and policies or facilitate criminal activity of any kind.
  • Engage in commercial activity or make money off the data story.

The Data User cannot make the data story widely accessible through the use of social media or other platforms. The Data User can publish blogs, reports, or papers that rely on key findings from the data story, but this would need case-by-case approval from the Data Steward. If such requests are approved, Data Users would then need to include a proper attribution to

Using and reproducing the data story or its findings in any form, whether for permitted purposes or as part of a blog/report/paper with approval, without proper attribution to the Alberta Human Trafficking Data Portal (AHTDP) constitutes a violation of the terms of this agreement.

In addition, you may not, nor may you allow others to, directly or indirectly:

  • Use the website hosting the data story in any manner that could damage, disable, overburden, or impair it.
  • Interfere with the security of the data story or the website hosting the data story or otherwise abuse the data story or any services, system resources, accounts, servers, or networks connected to or accessible through the Website or affiliated or linked Websites.

Please note that the lists for permitted and prohibited data uses are not exhaustive, and any additional data uses that are not included in these lists should be discussed with the Data Steward to ensure that they are permitted.

Confidentiality, Privacy and Security

Data collection, use, access, and storage for the data story has been guided by the five safes model, which emphasizes safe people, safe projects, safe settings, safe data, and safe outputs as key elements to maintaining data confidentiality, privacy, and security. In line with these principles, the data story is only available to staff and/or volunteers at Trusted Partners who will agree to these terms and conditions of use (safe people), the data story is in the public interest in helping us better understand human trafficking (safe projects), appropriate infrastructure is in place to ensure data confidentiality and security (safe settings), the data is de-identified and aggregated to reduce the risk from disclosure (safe data) and the data story only uses the de-identified, aggregated data (safe outputs).

Ownership and Limited License

The data story is owned by the Alberta Human Trafficking Data Portal and its data contributors. The Data User has no claim to the data story beyond the terms of this agreement. By granting the Data User access to the data story, the Alberta Human Trafficking Data Portal (AHTDP) does not grant any ownership rights to the Data User. The Data User can use the data story for the purposes described in section 1: Background and Purpose while complying with all terms and conditions in this agreement. When using the data story in accordance with this agreement, the Data User must give proper attribution to the Alberta Human Trafficking Data Portal.

Citation

When giving proper attribution to the Alberta Human Trafficking Data Portal, please use the following citation.

Alberta Human Trafficking Data Portal (AHTDP). 2023. “Creating a more complete picture of human trafficking in Alberta.” Available only to Provincial Human Trafficking Network organizations. Accessed [update to your access date].

Termination

If a Data User from a Trusted Partner knowingly and willingly violates the conditions of the Data User agreement, then the Trusted Partner’s access to the data story will be withdrawn and the Data User agreement will be terminated without notice.

A Trusted Partner’s access to the data story and Data User agreement will also be automatically terminated without notice if the Trusted Partner is no longer part of the Provincial Human Trafficking Network (PHTN).

Trusted Partners can also choose to terminate the Data User agreement by contacting the Data Steward and indicating their intent to not use the data story. Once they contact the Data Steward, their access to the data story will be withdrawn.

After a Trusted Partner’s access to the data story is withdrawn and the Data User agreement terminated, they must securely destroy any copies of the data story that Data Users from the organization might have and certify destruction to the Data Steward.

Warranties and Disclaimers

The data story is provided “as is” without any warranty of any kind. The Alberta Human Trafficking Data Portal (AHTDP) does not provide any guarantees about:

  • How the data story might or might not benefit different organizations or groups either now or in the future.
  • The duration for which the data story will be made available since that is subject to several different factors.
  • The accuracy, completeness and reliability of the data represented in the data story.
  • The security of the data story in terms of viruses or data breaches.

Limitation of Liability

The Data Steward and their delegate(s) are not be responsible or liable for any direct or indirect damage to the Data User that arises out of the use of the data story including, but not limited to, the loss of data, loss of revenue, emotional distress, or any other tangible or intangible harm regardless of whether the action is in contract, tort (including negligence), civil liability or otherwise. By accepting this Data User agreement, the Data User agrees to indemnify the Data Steward and their delegate(s) from any claim or action and the Data User accepts that the Data Steward and their delegate(s) will not be liable for any damage to the Data User. In doing so, the Data User assumes any risk associated with the use of the data story. This limitation of liability will survive the termination of the Data User agreement.

Governing Law

This agreement is governed by the applicable provincial laws of Alberta and federal laws of Canada.

Entire Agreement Disclaimer

This agreement represents the entirety of the agreement between the Data User and the Data Steward and supersedes any other verbal or written communication about the data story.

Acceptance

You agree that you are solely responsible for all your actions and communications undertaken or transmitted in the course of your usage of the data story, and that you will comply with all applicable laws concerning the use of or activities on the data story in respect of the Content. You will be solely liable for any damages resulting from any infringement of copyright, trademark or other proprietary right, or any other harm resulting from your use of the data story.

It is the Data User’s responsibility to ensure that their use of the data story complies with these terms and to seek permission from the Data Steward for any uses not specified or permitted in this agreement.

By clicking “agree”, the Data User acknowledges that the Data User has read this agreement, understands it fully and has chosen to abide by its terms and conditions.
